Introduction & Contractual Parties
This User Agreement (“Agreement”) constitutes a legally binding contract between you (“User”, “you”) and TheoderAI (“Company”, “we”, “us”), governing your access to and usage of our websites, mobile applications, conversational AI interfaces, and educational tools (collectively, the “Services”).
If you do not agree to this contract, do not register for, access, or otherwise use any of our Services.
Eligibility, Minor Consent & DPDP Act Compliance
2.1Age Threshold & Verifiable Consent
In strict compliance with Section 9 of the Digital Personal Data Protection (DPDP) Act 2023 and the DPDP Rules 2025 (notified on November 13, 2025), you must be at least 18 years of age to use our Services independently.
If you are under 18, you are legally classified as a minor. TheoderAI is legally prohibited from processing your digital personal data unless we obtain verifiable parental consent from your parent or lawful guardian.
2.2Parent/Guardian Verification Mechanisms
To satisfy Section 9(1) of the DPDP Act, we employ robust, legally compliant verifiable consent mechanisms before onboarding any minor:
- Email-Plus Verification: A multi-step confirmation process initiated via the parent's email.
- Credit Card/Payment Gateway Authentication: A nominal, temporary transaction to verify adult financial authority.
- Government ID Verification: Secure, encrypted uploading of standard government-issued identification.
- Video-Based Verification: Real-time video face matching and age verification.
- Knowledge-Based Authentication: Contextual security questions tailored to adult records.
2.3Child Data Protection & Fiduciary Duties
As a “Data Fiduciary” under the DPDP framework, TheoderAI strictly adheres to the core principles of data minimization, purpose limitation, and storage limitation. For minor users, we enforce the following statutory prohibitions:
- No Behavioral Tracking: We do not track, monitor, or log the online behavior, screen time, keystrokes, or habits of minor users.
- No Targeted Advertising: We are strictly prohibited from serving targeted advertisements directed at children.
- No Detrimental Profiling: We will not engage in any digital profiling that may have a detrimental impact on a child's psychological or emotional well-being.
AI Safety, Ethics & Algorithmic Governance
3.1Adherence to National AI Standards
TheoderAI's backend architectures, Large Language Model (LLM) routers, and generative tutoring pipelines strictly comply with the India AI Governance Guidelines 2025 (notified on November 5, 2025) and the MeitY AI Advisories. We operationalize the seven foundational principles of the national AI framework:

3.2Strict Prohibitions Against Algorithmic Bias
We warrant and implement technological safeguards to ensure our AI models, software, or algorithms do not generate or permit any form of bias, discrimination, or threat to electoral integrity, nor do they permit users to host, publish, or transmit any unlawful content as outlined in Rule 3(1)(b) of the IT Rules.
3.3Human-in-the-Loop & Chatbot Disclosure
In accordance with the RBI FREE-AI Framework (August 2025), we provide explicit disclosure to users indicating that they are interacting with an automated AI system.
For high-impact learning recommendations, score predictions, or diagnostic assessments, a “human-in-the-loop” oversight mechanism is maintained, giving a qualified human moderator the ultimate authority to review, override, or appeal an AI-driven decision.
3.4Algorithmic Auditing Rights
To ensure absolute public safety and transparency, our Terms of Service explicitly permit independent audits of our AI engines by recognized research institutions or third-party audit agencies to probe our systems and identify any hidden biases, risks, or unexpected model behavior.
Intermediary Compliance & Content Moderation
If you participate in our peer cohorts, study forums, or post text and resources within our community feeds, you are bound by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
4.1Restricted Information (Rule 3(1)(b))
You agree and undertake not to host, upload, display, modify, publish, transmit, store, or share any information that is harmful, defamatory, obscene, invasive of another's privacy, racially offensive, promotes money laundering, infringes intellectual property, or threatens the sovereignty, integrity, and security of India.
4.2Content Takedown Timelines & Due Diligence
Upon receiving actual knowledge via a court order, government intimation, or a user grievance regarding unlawful content, we will act expeditiously to restrict access to such material:

- Artificially Morphed Images & Impersonation: Any complaint regarding deepfakes, identity theft, or morphed images under Rule 3(2)(b) will be removed or disabled within 24 hours.
- General Unlawful Content: Complaints for the removal of content violating Rule 3(1)(b) will be addressed and resolved within 72 hours of receiving the complaint to prevent digital virality.
- Other Grievances: Standard user grievances will be resolved within 15 days.
4.3Annual Reminder of Platform Termination Rights
In accordance with Rule 3(1)(c) of the IT Rules 2021, we will periodically inform you — at least once every year — that in case of non-compliance with our terms, privacy policy, or user agreement, we reserve the right to immediately terminate your access, disable your account, or remove non-compliant content.
CCPA Coaching Sector Guidelines 2024
We are committed to fair trade practices under the Consumer Protection Act, 2019, and strictly adhere to the Central Consumer Protection Authority (CCPA) Guidelines for Prevention of Misleading Advertisement in Coaching Sector, 2024.
5.1Ban on Misleading Guarantees
TheoderAI strictly prohibits any misleading claims, false success rates, or exaggerated representations in its public-facing material. We do not make abstract, non-quantifiable, or false claims such as:
None of the above claims will be made at any stage of the UPSC or GATE examinations.
5.2Post-Selection Testimonial Consent
To eliminate coercive upfront sign-ups, we will never use your photograph, name, exam rank, or testimonial in our marketing or advertisements without your explicit, written post-selection consent. This consent must be obtained only after your final results have been officially declared by the respective Commission.
5.3Absolute Disclosure & Disclaimer Prominence
If any successful candidate's story is featured on our platform, we will transparently disclose their full name, official rank, and the exact course details. Whether the course was paid for or provided under a scholarship will be clearly stated. Any disclaimers or qualifiers will be displayed in the same font size as the primary claim, completely eliminating misleading fine print.
Consumer Protection E-Commerce Rules
Under the Consumer Protection (E-Commerce) Rules, 2020, TheoderAI operates under strict e-commerce guidelines:
6.1Explicit Consent Capture
We record consumer consent for any educational product or billing subscription strictly through explicit, conscious, and affirmative user action. We do not record automatic consent, and the use of pre-ticked checkboxes or forced opt-ins is strictly prohibited.
6.2Ban on Manipulative Reviews
TheoderAI, its developers, full-time employees, and affiliates are strictly prohibited from posing as consumers to write fake reviews, artificially game ratings, or misrepresent the quality of our educational content.
6.3Defect-Based Refunds & RBI E-Mandate
Your statutory refund rights under the Consumer Protection Act 2019, and our RBI-compliant auto-debit and pre-debit notification obligations, are described in full in our Refund Policy.
Disclaimer & Limitation of Liability
8.1"As-Is" Service & AI Limitations
The Services, including all AI-generated content, conversational responses, and study schedules, are provided “as is” and “as available”. AI-generated responses can occasionally contain errors or “hallucinations”. You are solely responsible for independently verifying all critical historical facts, syllabus mappings, or legal citations.
8.2Exclusion of Consequential Damages
To the maximum extent permitted by Indian law, TheoderAI, its parent entities, directors, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes but is not limited to:
- Exam failure or poor performance.
- College admission denials or job placement outcomes.
- Loss of profits, revenue, or business opportunities.
- Emotional distress or mental anxiety resulting from AI-generated feedback.
8.3Statutory Liability Cap
